EPF reports 422 defaulting company directors to Immigration [ 29-05-2012 ]

KUALA LUMPUR: The Employees Provident Fund (EPF) submitted the names of 422 defaulting company directors to the Immigration Department between January and March 2012.

The move was to prevent the errant directors from leaving the country unless they had first settled their employees' EPF contribution arrears, under Section 39 of the EPF Act 1991.

"The action taken against the directors of defaulting companies is part of our diligent enforcement exercise," said EPF general manager for public relations, Nik Affendi Jaafar.

He added the action proved the EPF's determination to safeguard the members' retirement, adding that "we will not hesitate to take stringent action, including levy actions and civil suits, against employers and company directors who have failed to meet the EPF obligation."

In the January-March quarter, 160 errant employers were fined a total of RM155,400 by the courts under Section 43(2) of the EPF Act 1991.

A total of 255 civil suits and 892 criminal cases were also filed with the courts against employers who defaulted on their employees' monthly EPF contributions.
